TERMS OF LEASE AGREEMENT
In addition to the terms below, and the operation guidelines on each rented item, the Lessee (customer) agrees to supervise the operation of any rented item and further agrees that if the item is damaged that he/she will reimburse A Bouncing Fun Time for the full price to fix the damage and/or the full replacement value of the rented item. Before signing this contract, Lessee agrees that he/she has read the entire contract, has agreed to all terms and conditions herein, and has had all questions he/she may have answered to the Lessee’s full satisfaction and understanding.
Delivery/Operation/Payments: To address specified by Lessee. Lessee grants A Bouncing Fun Time and its employees/contractors, the right to enter said property for the delivery and return of the rented equipment at approximate times. All payments must be made 96 hours prior to delivery. No refunds will be made inside 96 hours of scheduled event. The lessee agrees to provide one electrical outlet rated at 115 volts with 20 amperes capacity per motor unit within 100 feet of each unit. Delivery area must be reasonably accessible, clean, and free of debris, rocks, sticks, dog droppings, etc.. If A Bouncing Fun Time personnel attempt to make delivery and the area is not readily accessible or fit for the equipment, the equipment will not be set up and the rental fee will be forfeited. Only electrical cords provided by A Bouncing Fun Time are to be used. If the blower stops or the air pressure is low, remove all users immediately, and then check on the problem. Air tubes in the rear of the unit should be tied securely to the blower or tied off to prevent air from escaping. The electrical cord should be plugged into an outlet and be the only thing operating on that electrical circuit. Circuit breakers should also be checked. Customer is subject to an additional charge of $20.00 for all service calls due to electricity.
General Rules for Safe Operation: Equipment must be operated over a smooth, compatible surface such as grass or hard top surface. The equipment may NOT be operated/used on rough surfaces such as rocks, brick, glass, or any jagged objects. Unit cannot be moved by lessee after placed by A Bouncing Fun Time employees/contractors. Unit MUST BE properly anchored prior to use. Unit will be anchored initially by A Bouncing Fun Time employees/contractors and the anchors MUST NOT be removed during period of use. NEVER attempt to relocate, adjust or service a blower. NEVER use during winds over 15 mph, gusty winds, thunderstorms or lightening. The unit can turn over in high winds, even if anchored, and this could result in severe injuries to the users. ALWAYS turn off the unit during adverse conditions as described. Do not resume use until adverse weather conditions have ceased. Always follow the manufacturer’s guidelines located on the unit itself.
Additional Safety Rules: Before entering the unit, have the users remove their shoes, eye glasses, belt buckles and any sharp objects. Only children of the same age group are to play on the unit at the same time. NEVER play, jump or enter a partially inflated/deflated unit. NEVER allow the users to climb or play on the outside or inside walls of the unit, columns, netting or roof of unit. ALWAYS follow the number of riders and rules posted on the unit itself. Do not plug or unplug the motor repeatedly as this will cause the unit to burn up and you will be responsible for any resulting damage. ALWAYS have an adult present, who has reviewed and understands both this contract and the rules posted on the unit itself, who can supervise the riders. NEVER allow the users to be unsupervised in or around the unit. NEVER allow more users than the maximum number of users per age group as described within this lease and on the unit itself. NEVER place a hose or water on or into the unit unless authorized by A Bouncing Fun Time. NEVER allow horseplay, flips, or somersaults on, in, or around the unit. ALWAYS follow the directions for use on the unit itself. NEVER jump from the climber back into the climbing/jumping area. NEVER bounce on the front step. NEVER allow pets, smoking, or barbeques in or near the unit. NEVER allow anyone in the unit that has a history of back or neck problems, is physically impaired, intoxicated or under the influence of any intoxicating substance or any child who is not feeling well. NEVER allow anyone in the rear of the ride or near the electric blower fans at any time. NEVER allow the unit to be on and unsupervised. NEVER allow anyone to act in a manner that could injure themselves or others. ALWAYS keep spectators beind the crown barrier. Anyone not following the rules should be required to leave. Be safe! Additional Terms of Lease: A Bouncing Fun Time is not responsible for bad weather, disruption of electrical service and/or unfavorable conditions that may arise and no charges or fees will be reimbursed as a result. ABSOLUTELY NO silly string or similar items, such as, but not limited to, food, drinks, confetti, foam or trash, in or around the unit at any time !!! Silly string and like objects will cause permanent damage to the unit and lessee will be responsible for the full replacement value of the rented unit and/or assessed a cleaning fee of $70.00 per man hour of cleaning time if the unit is determined not to be permanently damaged. Lessee agrees not to operate the unit(s) in a manner contrary to this contract and the rules of use on each unit. If lessee operates the unit (s) in a manner contrary to the contract and rules of use on each unit, and the unit is damaged, Lessee agrees to pay the cost or repair or full replacement value of any damaged equipment or unit.
Lessee agrees that the equipment leased is for Lessee’s own use and said equipment is not be loaned, sub-let, mortgaged or in any other manner disposed of by Lessee. Lessee further agrees to be liable for any loss of said equipment by reason of fire, theft, or any other cause.
Hold Harmless Provisions: Lessee agrees to indemnify and hold A Bouncing Fun Time, its officers, employees, and contractors harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless A Bouncing Fun Time, its officers, employees, and contractors from injuries or damages incurred as a result of the use of the leased equipment. A Bouncing Fun Time, its officers, employees, and contractors cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless A Bouncing Fun Time, its officers, employees, and contractors from any loss, damage, theft or destruction of the equipment during the term of the lease and any extensions thereof.
Disclaimer of Warranties: A Bouncing Fun Time makes no warranty of any kind, either express or implied, as to the condition of or performance of any leased equipment and Lessee agrees to immediately cease use of the equipment and contact A Bouncing Fun Time if any of the lease equipment develops any indication defect or improper working conditions. Lessee agrees to use the equipment at Lessees own risk.
Breach/Indemnity/Arbitration: In the event that Lessee breaches any of the terms of this lease, that Lessee will pay for all consequential damages and further indemnify A Bouncing Fun Time for all costs incurred by A Bouncing Fun Time incurred in enforcing the terms of the lease or in defending any claim or lawsuit arising out of the operation of said equipment, including the amount of any judgment, attorney’s fees and costs. If A Bouncing Fun Time determines, within its own discretion, that Lessee has failed, in any way, to observe or comply with the conditions of this lease, A Bouncing Fun Time may exercise any of the following remedies: termination of this agreement; reenter property and retake the equipment; declare any outstanding rent and charges immediately due and payable and initiate whatever legal proceedings necessary to recover said equipment or monies; and/or pursue any additional remedies available it by law. If a conflict arises, A Bouncing Fun Time and Lessee will abide by the PA state laws and forgo filing a lawsuit to solve the dispute.
BY SIGNING MY NAME ON THIS CONTRACT I, BEING THE LESSEE, CONTACT PERSON, LESSEE REPRESENTATIVE, OR OTHER INDIVIDUAL ASSUMING THE ROLE OF LESSEE, ACKNOWLEDGE THAT I HAVE COMPLETELY READ AND UNDERSTAND THIS CONTRACT AND ANY AND ALL ACCOMPANIED ADDENDUM(S). I HAVE BEEN FULLY INSTRUCTED BY A Bouncing Fun Time PERSONNEL AS A TRAINED OPERATOR FOR THE AFFORMENTIONED EQUIPMENT AND HAVE HAD ALL OF MY QUESTIONS ANSWERED TO MY SATISFACTION. I UNDERSTAND THAT I AM SOLEY RESPONSIBLE FOR ADHERING TO THE TERMS SET FORTH BY THIS RENTAL CONTRACT AGREEMENT AND ANY AND ALL ACCOMPANIED ADDENDUM(S).

RELEASE AND ASSUMPTION OF RISKS
ASSUMPTION OF RISKS: The lessee understand and acknowledge that the activity to be engaged in through my rental of an interactive amusement game(s) and/or other amusement equipment such as jump houses, brings with it both known and unanticipated risks to its guests, its invitees and self. Those risks include, but are not limited to falling, slipping, crashing and colliding which could result in injury, illness, disease, emotional distress, death and/or property damage to self or guests and invitees.
LIABILITY RELEASE: The lessee voluntarily releases, indemnifies and agrees to hold harmless and discharge A Bouncing Fun Time (hereinafter collectively referred to as ABFT, from any and all liability, claims, demands actions or rights of actions, whether personal to self or to a third party which are related to, arise out of or are in any way connected with the rental of the interactive inflatable unit including those allegedly attributable to negligent acts or omissions. The lessee agrees to reimburse any reasonable attorney's fees and costs that may be incurred by ABFT in the defense of any such liability claim, demand, action or cause of action.
In the event that the lessee files a cause of action against ABFT the lessee agree to do so solely in the state of Pennsylvania and further agrees that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. The lessee agrees that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
Lessee acknowledges and represents that Lessee has adequate homeowner's insurance, tenant insurance, or OTHER liability insurance to cover any bodily injury or property damage which might occur to self, guests or invitees from the use of the unit being rented or else lessee agree to bear the costs of any such injury or damage itself.
RULES: Lessee agrees to supervise both the equipment and its use at all time said equipment is in the possession of the lessee. Accompanying this contract is a set of directions for use and safety rules that Lessee agrees to follow and utilize at all times during the operation and use of the inflatable unit.
The lessee acknowledge and certifies that Lessee has had sufficient opportunity to read this entire document, and understands its content and that it was executed freely, intelligently and without duress of any kind and agree to be bound by its terms.

Ride Operator Training
• I agree that I am the ride operator while the inflatable is in my possession.
• I agree to follow the rules provided in the Rental Agreement.
• In the event the inflatable is in my possession for multiple days, I agree to do a basic Pre-Operations inspection daily before use, using provided form.
• In the event of high winds or storms, I am instructed to get all participants off the unit, turn off the blower motor and unplug the motor and extension cord from the power outlet. Refer to the Beaufort Wind Scale attachment.
• I have been instructed to not allow any horseplay, flips, wrestling, bodily contact or any other unsafe activities both in and around inflatable.
• I have been advised and will enforce the following…
o No shoes or sharp objects in or around the inflatable unit(s);
o No food drinks or gum
o No eyeglasses or jewelry
o No face paint
• I have been advised that children of the same size or age group only may use the unit(s) at any given time, no adults.
• I agree to remove any person from the inflatable who is violating posted rules of operation or rules provided in the Rental Agreement.
• I agree to deflate the inflatable when it is not in use or not being supervised. Place the blower motor power switch in the OFF position to deflate. Unplug power cord from power source.
• I understand that adult operators (18 years old & up) must be provided to watch the inflatable at all times. I am responsible to train any additional operators needed.
• If I experience any problems, call (610) 473-5867.
• I have received written and/or verbal instruction on the safe operation of inflatable and agree to follow all safety rules.

PROTECTIVE TARP INSTRUCTIONS
Thank you for renting inflatable entertainment from A Bouncing Fun Time!
We pride ourselves on giving our customers the most time with the rented unit.
To do this we often deliver and set up the day before your event and/or pick it up the day after your event.
To be able to maintain this commitment to our customers and to reduce the chances of mold or mildew in the units, we need your help protecting our equipment. For this reason, if there is ANY chance of rain or dew, your unit will be installed with a tarp over top of it.
Please follow these instructions when it is time for you to use the inflatable (before turning on the blower).
1. Unhook the bungee cords from the spikes on one side.
2. Pull the tarp back to the still connected side.
3. Tuck the tarp under the unit to keep it from interfering with your participants or event.
4. Turn on the blower and HAVE FUN!
When you are finished having fun or if it starts to rain, follow these instructions.
1. Turn off the blower.
2. Allow for the unit to deflate. You may loosen the connection at the blower to quicken the deflation process.
3. Put the tarp over the inflatable unit and re-secure it.
4. Check and ensure that all corners are attached to anchor points with the bungee straps.
If we arrive to pick up the unit and the tarp has not been placed back over the unit, and it is flooded or has collected dew, we will assess a drying and cleaning fee of $70 per man hour of time required.
